By accessing or using the NomAgain platform — including our website (nomagain.com), customer portal (*.nomagain.club), and any partner restaurant websites powered by NomAgain — you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

NomAgain is a platform that connects customers with partner restaurants. We provide: - **Custom-branded websites** for partner restaurants - **Online ordering** (pickup, delivery, dine-in) through partner restaurant websites - **A loyalty and rewards program** where customers earn points on eligible purchases and redeem them for rewards - **Staff dashboard** for order management, menu management, and analytics - **Account management** for customers to view order history, track points, and manage preferences NomAgain acts as a technology provider. Each partner restaurant is independently owned and operated. We are not a restaurant, food delivery service, or food preparation business. NomAgain does not supply delivery drivers.

To use certain features of our platform, you must create an account. When registering, you agree to: - Provide accurate, current, and complete information - Maintain and promptly update your account information - Keep your login credentials secure and confidential - Not create more than one account per person - Not share your account or let others access it - Accept responsibility for all activity under your account You may register using an email address or through a third-party login provider (such as Google, Facebook, or Apple). By using a third-party login, you authorize us to access basic profile information as described in our Privacy Policy.

When you place an order through our platform: - **Pricing** is set by each partner restaurant and may change without notice. All prices are displayed in USD. - **Payment processing** is handled securely by Stripe. NomAgain does not store your full credit card details. - **Tips and delivery fees** are collected on behalf of the restaurant. Restaurants keep 100% of tips and delivery fees. - **Order confirmation** constitutes a binding transaction between you and the partner restaurant. - **Taxes and fees** (if applicable) are calculated at checkout and clearly displayed before you complete your order. - **Refunds and cancellations** are handled by the partner restaurant. If you have an issue with an order, please contact the restaurant directly or reach out to us at hello@nomagain.com for assistance. NomAgain is not responsible for food quality, preparation, allergens, or delivery. These are the sole responsibility of the partner restaurant.

Our loyalty program allows you to earn and redeem points at participating partner restaurants. By participating, you agree to the following: - **Earning points:** Points are earned on eligible purchases at the rate set by each partner restaurant. Points are credited after your order is confirmed. - **Redeeming points:** Points can be redeemed for rewards as listed in each restaurant's rewards catalog. Available rewards may change at any time. - **Points have no cash value.** Points cannot be exchanged for cash, transferred to another account, or sold. - **Expiration:** Points may expire after a period of account inactivity, as determined by the partner restaurant's loyalty program terms. - **Program changes:** We reserve the right to modify, suspend, or discontinue the loyalty program at any time. We will make reasonable efforts to notify you of material changes. - **Abuse:** Fraudulent activity, manipulation of the points system, or abuse of rewards may result in forfeiture of points and account termination.

When using our platform, you agree not to: - Use the platform for any unlawful purpose - Submit false or misleading information - Attempt to gain unauthorized access to any part of the platform - Interfere with or disrupt the platform's operation - Use automated tools, bots, or scripts to access or scrape the platform - Abuse the loyalty program or attempt to fraudulently earn or redeem points - Harass, threaten, or harm other users, restaurant staff, or NomAgain personnel - Impersonate any person or entity We reserve the right to suspend or terminate accounts that violate these rules.

**NomAgain's property:** The NomAgain name, logo, branding, platform design, software, and all related intellectual property are owned by NomAgain. You may not copy, modify, distribute, or create derivative works from our platform without written permission. **Restaurant content:** Menu items, descriptions, images, and other content provided by partner restaurants remain the property of those restaurants. **Your content:** By submitting reviews, feedback, or other content to our platform, you grant NomAgain a non-exclusive, worldwide, royalty-free license to use that content in connection with our services.

Our platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, NomAgain disclaims all warranties, express or implied, including but not limited to: - Implied warranties of merchantability and fitness for a particular purpose - That the platform will be uninterrupted, error-free, or secure - That any defects will be corrected - The accuracy or reliability of any information on the platform NomAgain does not guarantee the quality, safety, or legality of any food or services provided by partner restaurants.

To the maximum extent permitted by applicable law, NomAgain and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the platform. Our total liability for any claim arising from your use of our services shall not exceed the amount you paid to NomAgain (not including payments to restaurants) in the twelve (12) months preceding the claim.

We may suspend or terminate your account at any time if we believe you have violated these Terms of Service, engaged in fraudulent activity, or for any other reason at our sole discretion. Upon termination: - Your access to the platform will be revoked - Any accumulated points may be forfeited - Provisions that by their nature should survive termination will remain in effect You may also delete your account at any time by following the instructions on our Data Deletion page or by contacting us at privacy@nomagain.com.

These Terms of Service are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of our platform shall be resolved in the courts located in Los Angeles County, California.

We may update these Terms of Service from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes, we will notify you by email or by posting a prominent notice on our website. Your continued use of the platform after changes take effect constitutes acceptance of the revised terms.
